The goods, products and or services being placed, accessible and orderable upon the website i.e. https://mermaidforbeauty.store/("this site") by Biotek India (‘Biotek’) or by its affiliates on its behalf, is mere an invitation to offer made by Biotek and or by its affiliates to You, whereupon You may make offer to purchase, buy, avail the goods, products or services from this site, whereby the Biotek may or may not accept Your offer and the Shipping, Return and or Refund pertaining to your offer to purchase, buy, avail the goods, products or services shall be governed by this Shipping, Return and Refund Policy(“this Policy”). We know and appreciate your concern towards having knowledge about the mode, manner, outlay/payout and allied details in respect of the offer to buy, avail the goods, products and or services being placed by You with Biotek. This page informs you of our policies regarding the mode, manner and method of Shipping the goods and products with regards to the accepted offer to buy and purchase the goods or products from this site, cancellation of the accepted offer/contract by You or Biotek, Collection of returned goods and products and refund, payment towards such returned products.

By placing order from this Site, thereby offering to purchase, avail or buy goods, products or services from this site, you agree, consent and accept to the Shipment, Return and Refund Payments in accordance with this policy as amended by Biotek from time to time and shall adhere to it at all times.

Shipping Policy:

• Biotek, after the confirmation and acceptance of Your offer to purchase and buy the goods from this site, shall ship and deliver the goods to You through third party service providers.
  
• Shipping/Delivery charges may vary from Product to Product and shall be notified by Biotek at the time of placing the order to purchase the goods from this site.
  
• Generally, the Tester Packages/Goods of the Biotek shall carry delivery charges of Rs.199 which shall be reimbursed/adjusted by Biotek in eventuality of You have placed order of the same products order in Tester Packages of Products (Tester Packages of Products are such Products being invited to be offered for sale to You in relatively smaller quantity for specific purposes of determining and affecting your decision to Order the Products in Larger Quantities as are invited to be offered for Sale) and being confirmed by Biotek, during the same month of purchase/placing of Order of Tester Packages. However the exact shipping and delivery charges which may vary from this policy as is changed and amended from time to time by Biotek and therefore the exact shipping and delivery charges may be notified to You at the time of Placing Order of the Goods from this site.

• In case of the subsequent purchases of Goods being accepted to be sold by Biotek, save and except the Tester Packages of Products, such Purchase Price shall be inclusive of Delivery Charges, and other taxes and changes, unless otherwise stated and notified to You at the time of Placing of the Order from this site.

• It is possible that Biotek or third-party courier partners may have a holiday between the day you place your order and the date of delivery, which is based on the timelines shown on the product page. In this case, we add a day to the estimated date. Some third party courier partners do not work on Sundays and this is factored in to the shipping/delivery dates, however the shipping/ delivery dates being shown to you are tentative and estimates and therefore Biotek shall in no case be held responsible to deliver the Products as is ordered by You within such tentative delivery dates and no claim shall lie against Biotek due to delay or such other allied reason against Biotek and or its third party courier/delivery partners.

• In case Your location to deliver/ship the Goods is remote and the Biotek and or its delivery Partner do not ship and or deliver the goods to such location, the same shall be intimated to You and in such eventuality You may either choose to avoid ordering the product from this Site or collect the goods as ordered from the nearest destination/collection point as may be notified and intimated to You during the placement of Order from this Site.

• Biotek in current scenario does deliver products internationally subject to payment of additional delivery/shipping charges being notified to You at the time of Placing of the Orders.

• Biotek shall deliver/ship the products with tampered proof sealed package/packaging however in case of You having any notice about the tampering being observed in such packaging, You may return the same as per the Policy mentioned herein below to be eligible to either exchange or refund of the Purchase Price.

• Biotek shall not be under any obligation to ship and deliver the products as order by You in case the products are not available in Stock of Biotek at the relevant time.

• Biotek shall deliver the goods to you through third party shipper/delivering person or agency and therefore the risk of loss and title for such products pass to you upon our delivery to the person or agency. You are solely responsible for providing us with accurate shipping information and in case of your order getting lost due to inaccuracy on your part, we shall not be held liable and shall not refund any amount of Purchase Price, consideration or part thereof.

Cancellation Policy:

• You may cancel your confirmed order (the offer to buy/purchase the goods or avails services placed by You and being accepted by the Biotek) subject to the condition that the goods/products ordered by You from this site are not available at the relevant time after placing order with Biotek in stock of Biotek and the refund of the same shall be processed per Clause 3(I) of this policy.

• Biotek may in its sole discretion cancel or terminate the offer or Order placed by using this site of Biotek and the refund of the same may be processed per clause of this policy.

• You may cancel your confirmed order (the offer to buy/purchase the goods or avails services placed by You and being accepted by the Biotek) after placing the order with Biotek, which is being already shipped by Biotek from its address and however which is in transit, due to which it is not received by You and the refund of the same shall be processed per Clause 3(II) of this policy.

Goods Return Policy:

• In any other eventuality other than mentioned in clause (1) herein above, if You wish to cancel your order accepted, confirmed by Biotek and consequentially shipped by Biotek to You, which is received by You then the Goods must be returned to Biotek at the address: Biotek India, 919/2,GIDC Estate, Makarpura,Vadodara-390010,Gujarat-India within 15 days of receipt of the goods/products, with valid reason of return of the goods, which valid reasons to be conveyed to Biotek along with fulfillment of all the followings conditions, in order to be eligible to receive Refund as per clause 3(III) of this policy, as may be decided and intimated to You by Biotek in its Sole Discretion:

• Goods returned shall be sent via courier or through any other mode along with all the package and packaging materials in their original and intact condition;

• Goods shall be returned in unused conditions without any reduction in its quantity and or volume;

• Returned Goods shall be securely wrapped and packaged to save it from any damage and or loss during transit by You;

• Goods Returned shall be accompanied by Delivery Slip/Invoice issued by Biotek;

• Goods shall be returned by You to Biotek totally and completely at your risk and cost.

• Biotek shall be under no obligation to collect or recover Goods from You in case you wish to opt for return of the Goods, but if we do, our costs will be payable by you.

Refund Policy:

• In case of cancellation or termination of the order confirmed and accepted by Biotek as was placed by You and not being available in stock of Biotek at the relevant time, You shall be eligible to avail and receive Full Refund of Purchase Price i.e. the Price at which the goods were sold to You by Biotek after reduction of all discounts and such refund shall be credited to your Bank Account or such Credit, Debit Card or Payment Mode as was originally used by You at the time of Placing Order, no later than 45-60 days from the date of Receipt of Request from You to Biotek to cancel and thereby refund such Payments.

• In case of Cancellation of Order confirmed and accepted by Biotek as was placed by You and which is being already shipped by Biotek from its address and however which is in transit, due to which it is not received by You, You may be eligible to avail and receive Refund of Purchase Price i.e. the Price at which the goods were sold to You by Biotek after reduction of all discounts and deduction of Shipping, Handing and Handling as are incurred by Biotek, and such refund shall be credited to your Bank Account or such Credit, Debit Card or Payment Mode as was originally used by You at the time of Placing Order no later than 45-60 days from the date of receipt of Request from You to Biotek to cancel and thereby refund such Payments.

• In case of Cancellation of Order and thereby Return of Goods as per Goods Return Policy provided in clause 2 hereinabove, You may be eligible to exchange the said product with the same the Product or to avail and receive Refund of Purchase Price i.e. the Price at which the goods were sold to You by Biotek after reduction of all discounts and deduction of Shipping, Handing and Handling as are incurred by Biotek further subject to fulfillment of all the conditions are mentioned in clause (2) hereinabove, such refund shall be credited to your Bank Account or such Credit, Debit Card or Payment Mode as was originally used by You at the time of Placing Order, no later than 45-60 days from the date of receipt of the Goods by Biotek at the address as is mentioned in clause (2) hereinabove.

• Placing of Order and Shipping/Delivering of Products from https://mermaidforbeauty.store/ is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. If you are a minor i.e. under the age of 18 years, you may use https://mermaidforbeauty.store/ only with the involvement of a parent or guardian, at your or such guardian's / parent's own risks and costs.

• Biotek reserve the right to update, vary, modify, change our Shipping, Return and Refund Policy at any time and you should check this Shipping, Return and Refund Policy periodically as and when you access the site. Your continued use of the Service after we post any modifications to the Shipping, Return and Refund Policy on this site shall constitute and deemed to mean your acknowledgment, consent, agreement of the modifications, amendments, variations, modifications and your consent to abide and be bound by the modified Shipping, Return and Refund Policy.

• If we make any material changes/amendment to this Shipping, Return and Refund Policy, we may notify you either through the email address you have provided us, or by placing a prominent notice on our website and upon such notification the amendment/ change/s in the Shipping, Return and Refund Policy is and shall become effective and applicable for all the purposes and in every respect.

Governing Law:

This policy shall be governed by and construed in accordance with the laws of Republic of India and the courts of Vadodara, Gujarat shall have the exclusive jurisdiction in this regard. This is the entire agreement between the parties relating to the matters contained herein.
